Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the Lightning Maths website and YouTube channel (the "Service") provided by Lightning Maths ("Lightning Maths", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
- "Visitor" means anyone who accesses the Service, whether a parent, guardian, teacher, child or other user.
- "Content" means all lessons, videos, quizzes, exercises, explanations, graphics and other material made available through the Service.
2. About the Service
- Lightning Maths provides free, self-paced maths lessons, quizzes and videos, accessed through a standard internet browser or via our YouTube channel.
- All lessons, videos and quizzes making up the free Content are free to use and require no account, registration, login or payment of any kind. We also offer certain optional paid digital courses for purchase, described in section 3 below; purchasing a course does not require creating an account either.
- The Service consists of automated, self-directed Content. It does not include live human tutoring, one-on-one teaching, or any real-time interaction with a tutor, teacher or staff member.
- The Service has no chat, messaging, discussion board, comment, profile or other social or peer-interaction feature of any kind.
- The Service is a supplementary self-directed learning tool. It is not a substitute for formal schooling, a qualified tutor, or professional educational or psychological assessment, and we do not guarantee any particular academic outcome, grade or result.
- The Service does not use urgency, pressure or other manipulative design directed at a child to encourage a parent or guardian to take any action ("pester power" design).
3. Paid courses
In addition to the free Content described in section 2, we offer certain optional paid digital courses for purchase ("Courses"). Purchasing a Course is optional and is not required to access any free lesson, video or quiz, all of which remain free and account-free regardless of whether you purchase a Course.
- Courses are purchased through a checkout provided by Stripe, a third-party payment processor. We do not receive, process or store your full card or payment details at any time; these are collected and processed directly by Stripe, and Stripe's own terms of service apply to that transaction. Our Privacy Policy describes what limited information we do receive.
- Purchasing a Course is designed for a parent or guardian to do, not a child, in the same way as the optional email sign-up described in section 5 below.
- After payment is confirmed, we will send access to the Course's video and, where applicable, written worksheet material to the email address used at checkout. Access is currently provided manually by us rather than through an automated member portal; this may change as the Service grows, and any change will be reflected in an updated version of these Terms.
- Course purchases are for personal use by the purchasing household only and are non-transferable. You must not share, forward, resell, publish or otherwise distribute Course access or Course Content to any person outside your immediate household.
- Course prices are displayed in Australian dollars (AUD) and are current at the time of purchase; we may change Course prices at any time, but a change will not affect a Course you have already purchased.
4. Refunds and consumer guarantees
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified. Our Courses come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill and will be reasonably fit for the purpose for which they are sold.
- If a Course fails to meet a consumer guarantee, you are entitled to a remedy under the Australian Consumer Law, which may include correction of the issue, provision of the Course as described, or a refund, depending on the nature and seriousness of the failure.
- To request a remedy or refund, contact us at hello@lightningmaths.com.au with the email address used at checkout and the name of the Course purchased.
5. Optional email sign-up
- A parent or guardian may optionally submit their email address at lightningmaths.com.au/signup to receive occasional updates about new lessons, along with a topic they'd like to see covered next.
- This is entirely optional and is not required to access any lesson, video or quiz, all of which remain free and account-free regardless of whether you sign up.
- You can unsubscribe from update emails at any time using the link included in each one.
- Our collection and handling of any email address or preference you submit is described in our Privacy Policy.
6. Eligibility and use by children
- Because no account is required, the Service is intended to be directly accessible to children, including without a parent or guardian present, consistent with its design as a free, safe, no-login learning resource.
- The optional email sign-up in section 5, and purchasing a Course under section 3, are both designed for a parent or guardian to do, not a child.
- Parents and guardians are encouraged to review this Service alongside their child, but are not required to register or provide any information to do so.
7. Intellectual property
Lightning Maths (all Content, software, trademarks, logos and other intellectual property comprising or delivered through the Service) is owned by or licensed to us and protected by Australian and international intellectual property laws. You may view and use the Content for personal, non-commercial, educational purposes. You must not copy, reproduce, distribute, sell, sublicense or publicly display Content, or reverse engineer, decompile, scrape, or attempt to extract the source code or underlying question banks of the Service, without our prior written permission.
8. Acceptable use
When using the Service, you must not:
- use automated means (bots, scripts) to access or scrape the Service;
- interfere with, disrupt or attempt to gain unauthorised access to the Service or our systems;
- use the Service for any unlawful purpose or in breach of these Terms.
9. Third-party platforms
Our videos are hosted on YouTube and may be embedded on our website. Use of YouTube itself (including creating a YouTube or Google account, or interacting with YouTube's own features) is governed by YouTube's own terms of service, not these Terms. We have published our videos under YouTube's "Made for Kids" designation, which disables personalised ads and comments on that content. Course payments are processed by Stripe; use of Stripe's checkout is governed by Stripe's own terms of service, not these Terms.
10. Availability and changes to the Service
- We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free access, and we may suspend the Service for maintenance, upgrades, or reasons beyond our reasonable control.
- We may add, remove or modify Content or features from time to time, including in connection with the future introduction of an optional paid membership (which is expected to include an online practice portal, and is separate from the Courses described in section 3). Lessons and quizzes that are currently free will remain free to use without an account; new content areas added in future (for example, planned high-school content) may be offered on a different basis, and any new paid features or paid Content will be clearly identified as such and will not retroactively apply to existing free Content.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, Lightning Maths excludes all warranties, conditions and representations, whether express or implied, other than those which cannot lawfully be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including the consumer guarantees described in section 4.
- To the maximum extent permitted by law, and subject to section 4, our aggregate liability arising out of or in connection with these Terms or the free Content is limited to re-supply of the Service, and our aggregate liability arising out of or in connection with a Course is limited, at our option, to re-supplying that Course or refunding the amount you paid for it.
- We are not liable for any indirect, special or consequential loss, or for any academic outcome, exam result, or educational attainment (or lack thereof) of any user.
12. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, our business structure, or the law, including the future introduction of an optional paid membership described in section 10. We will post the updated Terms on the Service with a revised effective date.
13. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts competent to hear appeals from those courts.
14. General
- If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.
- Our failure to enforce a right under these Terms is not a waiver of that right.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
